Tennessee: AG files motion for TikTok’s failure to preserve and produce relevant evidence in investigation to possible consumer protection law violations

On October 8, 2024, the Tennessee Attorney General (AG) announced that it filed a motion in the Twentieth Judicial District of Tennessee in relation to TikTok Inc.'s failure to preserve and produce relevant evidence in response to the State's investigation on TikTok's possible violations of Tennessee consumer protection laws.

The AG has requested the court to issue an order with the following relief:

  • a civil penalty of $1,000 for spoliation of evidence;
  • directing TikTok to produce all documents related to interviews of custodians conducted by TikTok’s in-house and outside counsel as part of an internal investigation into spoliation; and
  • compelling TikTok to produce:
    • relevant text messages sent or received by company executives as well as Trust & Safety Communications personnel;
    • unredacted copies of materials previously produced;
    • all preserved metadata associated with group secure chat threads; and
    • a comprehensive privilege log with all future rolling productions in the State's investigation.
