Regulator: The Georgia Attorney General ('AG')

Summary: Although there is no comprehensive privacy law in Georgia, on May 11, 2018, the Court of Appeals of Georgia held in the case of Connell et al. v. Georgia Department of Labor that there is no duty under Georgia state law to safeguard personal information. However, Georgia does operate its own data breach notification law under the Georgia Personal Identity Protection Act under §10-1-911 et seq. of the Official Code of Georgia Annotated which requires any information broker or data collector to notify a data breach to any resident whose unencrypted personal information was, or is reasonably believed to have been, acquired by an unauthorized person.
