Summary: Although there is no comprehensive privacy law in Wisconsin, the right to privacy is recognized under §995.50 of the Wisconsin Statutes & Annotations (Wis. Stat). In addition, there are various provisions within the WI Stat that regulate matters such as telephone records, disposal of records containing personal information, and unauthorized acquisition of personal information.
In addition, there is a requirement to notify data breaches under §134.98 et seq. of Article 98 of Chapter 134 of the Wis. Stat. Accordingly, a breach must be notified by an entity if its principal place of business is in Wisconsin or if it maintains or licenses personal information in Wisconsin and knows that personal information has been obtained by an unauthorized person.
