Summary: While general privacy legislation is awaited, breach requirements and the security of personal data is regulated by the Act Concerning the Maryland Personal Information Protection Act – Security Breach Notification Requirements – Modifications (the Personal Information Protection Act), which entered into effect on October 1, 2019. The Personal Information Protection Act requires any business that owns, licenses, or maintains computerized data that includes personal information of an individual residing in Maryland to notify affected individuals of a data breach. The Personal Information Protection Act also imposes security obligations on businesses that own or license personal information of Maryland residents. Bill No. HB0962 for an Act concerning Commercial Law – Maryland Personal Information Protection Act – Revisions made amendments to the Personal Information Protection Act and took effect on October 1, 2022.
