Regulator: The Missouri Attorney General ('AG')

Summary: There is no constitutional right to privacy in Missouri. However, the right has been recognized by State Courts and individuals can sue for the invasion of privacy. In addition, there is a requirement to notify data breaches under §407.1500 of Title XXVI of the Missouri Revised Statutes following the discovery or notification of a breach. Notification must be provided without undue delay to consumers and to the Missouri Attorney General (AG) if the breach involves the information of more than 1,000 Missouri residents. Notification may be provided in writing, in electronic form, or by telephone. Other Missouri legislation includes additional rules on communications, credit cards, and health information.
