Summary: While there is no comprehensive privacy law in Idaho, under §28-51-104 et seq. of the Idaho Statutes there is a requirement to notify affected consumers and the Idaho Attorney General (AG) of personal data breaches involving unauthorized access to unencrypted computerized records, with penalties for the intentional failure of notification. The AG holds the power to sanction violations of the law and issue penalties. Other applicable statutes in Idaho prohibit identity theft and electronic surveillance.
