Regulator: Wyoming Attorney General ('AG')

Summary: Wyoming does not currently have a law in place that specifically regulates data protection and consumer privacy. However, the Wyoming Consumer Protection Act generally protects individuals against unfair and deceptive practices, and the Consumer Protection Unit of the Wyoming Attorney General (AG) has the authority to examine consumer privacy invasions.

Another key privacy-related law in Wyoming is the Wyoming Genetic Data Privacy Act (GDPA) which regulates the collection, use, or disclosure of genetic data. The GDPA prohibits the collection of genetic data without consent from the individual concerned and creates a civil cause of action for violations of its provisions.

Moreover, Article 5 of the Consumer Protection Act on Credit Freeze Reports provides a breach notification requirement in the event of an unauthorized acquisition of computerized data maintained by a person or business, and which is believed to cause loss or injury to a resident of Wyoming. In such cases, affected data subjects must be notified without unreasonable delay and the AG has the authority to bring enforcement actions for non-compliance.
