EU: EDPB calls for coherence between GDPR and digital legislation
On December 4, 2024, the European Data Protection Board (EDPB) published Statement 6/2024 on the Second Report on the Application of the General Data Protection Regulation (GDPR) - Fostering Cross-Regulatory Consistency and Cooperation.
The EDPB highlighted the need for consistency in the application of legal certainty and coherency of digital legislation with the GDPR. Accordingly, the EDPB noted the need for cross-regulatory consistency and cooperation between regulatory authorities at the EU and internationally. Regulatory enforcement interplay between the GDPR and digital legislation such as the EU Artificial Intelligence Act (AI Act), the Digital Services Act (DSA), and the Digital Markets Act (DMA) among others, will require clarification.
The EDPB noted that it has already started working on guidelines concerning the interplay of the GDPR with other digital legislation, but that it will need to work to establish enforcement cooperation mechanisms between regulators. Guidance and tools will also be produced targeted at small and medium-sized enterprises (SMEs), non-experts, and children.
