Summary: The Access to Information and Protection of Privacy Act, SNL 2015 c A-1.2 (the Act) is the governing legislation for public bodies in Newfoundland and Labrador. In comparison, private organizations are regulated by the Personal Information Protection and Electronic Documents Act 2000 (PIPEDA). Also, the Personal Health Information Act (PHIA) guarantees protections for the use, disclosure, access, and confidentiality of protected health information (PHI). As it relates to PHI, the Office of the Information and Privacy Commissioner for Newfoundland and Labrador (OIPC) has limited powers of enforcement, including reviewing complaints and making recommendations to ensure compliance. The OIPC acts as an independent reviewer in the administration of both the Act and the PHIA.
