Canada: Canadian privacy regulators pass resolution on privacy-related harms from deceptive design patterns

On November 13, 2024, the Office of the Privacy Commissioner of Canada (OPC) announced that it and other Canadian privacy regulators have passed a joint resolution calling for action on the use of deceptive design patterns that undermine privacy rights.

According to the OPC, the joint resolution was passed at the annual meeting of federal, provincial, and territorial information and privacy commissioners and ombuds. The joint resolution outlines key measures for organizations to adopt privacy-first design practices.

The joint resolution urges organizations to carry out the following:

  • build privacy and the best interests of young people into the design framework;
  • limit the collection of personal information to what is necessary for a specific purpose;
  • use clear and accessible language;
  • regularly review and improve design elements of websites and apps to reduce exposure to deceptive patterns and support informed privacy choices; and
  • choose design elements that adhere to privacy principles.
