Poland: UODO provides comments on list of bodies and institutions in AI Act
On November 25, 2024, the Polish data protection authority (UODO) announced that it sent a letter to the Minister of Digitization highlighting concerns about the absence of the UODO from the list of public bodies and institutions responsible for protecting fundamental rights under the EU Artificial Intelligence Act (the AI Act). The UODO pointed out that this omission raises significant doubts, as the UODO plays a crucial role in overseeing compliance with EU law standards regarding personal data protection.
Furthermore, the UODO emphasized that the list, as specified in Article 77(2) of the AI Act, should include the President of the UODO to ensure the effective safeguarding of personal data rights. Additionally, the UODO referenced Article 74(8) of the AI Act, which clarifies that the supervisory authority's competencies apply to high-risk artificial intelligence (AI) systems, particularly those involved in law enforcement and democratic processes.
