Malta: IDPC releases Accreditation Requirements for Code of Conduct Monitoring Bodies

The Maltese Office of the Information and Data Protection Commissioner ('IDPC') announced, on 17 January 2023, the publication of its Accreditation Requirements for Code of Conduct Monitoring Bodies, following Opinion 37/2021 on the draft decision of the IDPC, pursuant to Article 64(1)(c) of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'), by the European Data Protection Board ('EDPB'). In particular, the IDPC highlighted that it had implemented all recommendations from the EDPB and that it had thus amended its draft requirements accordingly.

Notably, the Accreditation Requirements for Code of Conduct Monitoring Bodies provide, among others, details on:

  • the legal status of code of conduct monitoring bodies;
  • their independence;
  • their expertise;
  • their establishment of procedures;
  • their monitoring of compliance of entities adhering to the code of conduct; and
  • reasons for revoking monitoring bodies.

Lastly, the IDPC noted that it warmly welcomes initiatives on codes of conduct by interested parties and that it is available to provide all the necessary assistance in this respect.
