Kazakhstan: State of emergency decree requires the use of mobile applications for quarantine measures

OneTrust DataGuidance confirmed, on 6 April 2020, with Joel Benjamin and Yerbol Konarbayev, Managing Partner and Associate respectively, at Kinstellar LLP, that the Resolution of the Chief State Sanitary Office of the Republic of Kazakhstan dated 1 April 2020, On Measures Ensuring Safety of the Population No.30-PGVr in accordance with the Decree of the President of the Republic of Kazakhstan, On Announcement of the State of Emergency in the Republic of Kazakhstan ('the State of Emergency Decree'), "requires the heads of health departments in Almaty, Nur-Sultan and Shymkent, must ensure that quarantine measures at home, and the remote medical supervision of individuals which had close contact with individuals infected with COVID-19 ('Coronavirus'), provided that the conditions of isolation are available."

Furthermore Benjamin and Konarbayev highlighted that the conditions of isolation and to ensure remote supervision of individuals quarantined at home would be made by measures that ensure "that the individual quarantined at home must install on its smartphone a Smart Astana application and provide the application with [permission to] GPS, Wi-FI, Bluetooth." Additional conditions individuals must follow include, "[turning] on the 'I am on quarantine' mode and [to not switch this mode] off throughout the operation of the home quarantine regime, the phone must be constantly on and connected to the internet, the mobile application active or function in the background [and] while using the 'I am on quarantine mode', the user should not turn off [the phone's] GPS, Bluetooth or Wi-fi."
