Germany: DSK publishes guide on Online Access Amendment Act
On November 22, 2024, the German Data Protection Conference (DSK) published an application guide for public bodies providing cross-border online services according to the Online Access Amendment Act.
The DSK noted that the Online Access Amendment Act came into force on July 24, 2024 and includes amendments to the Online Access Act, the federal E-Government Act, and other legislative amendments. The guide provides changes that the DSK considers to be significant from a data protection perspective in order to support the bodies affected by the amendments.
More specifically, the guide provides information on the legal basis for processing in a cross-border online service and for processing for online services not offered across national borders. The guide also details the consequences of the Online Access Amendment Act, including obligations under the General Data Protection Regulation (GDPR).
