USA: ODNI discloses Intelligence Community Guidance on Acquisition and Use of Foundation AI Models
In November 2024, the U.S. Office of the Director of National Intelligence (ODNI) disclosed the Common Intelligence Community (IC) Interim Guidance Regarding the Acquisition and Use of Foundation AI Models.
The Guidelines highlighted that the IC is authorized to collect, retain, and disseminate US person's information for approved purposes in accordance with Executive Order (EO) 12333 on United States Intelligence Activities. The Guidelines also note their recognition of the principles provided under the Framework to Advance Governance and Risk Management in National Security.
On Model Acquisition, the Guidelines state that an artificial intelligence (AI) foundation model (FM) is 'acquired' if the model is hosted or accessed in a manner different from what is available to the general public for the model. However, the Guidelines clarify that acquiring an AI FM does not constitute the collection of training data, with the collection of training data depending on the specific facts and circumstances of the AI FM.
