Texas: Bill relating to prohibiting the use of political advertising manipulated by generative AI filed in Senate

On November 12, 2024, Senate Bill 228 for an Act relating to prohibiting the use of certain political advertising manipulated by generative artificial intelligence technology; creating a criminal offense, was filed in the Senate and received by the Secretary of the Senate.

Prohibition of AI-manipulated political advertising

The bill prohibits the publication, distribution, or broadcasting of political advertising that includes an image, audio recording, or video recording of an officeholder's or candidate's appearance, speech, or conduct that has been intentionally manipulated using generative artificial intelligence (AI) creating a realistic but false or inaccurate output.

Under the bill, a violation of the bill is qualified as a Class B misdemeanor.

Entry into force

The bill, if enacted, will enter into force on September 1, 2025.
