Russia: Draft law on processing of personal data and protection of consumer rights submitted to State Duma

On July 30, 2024, OneTrust DataGuidance Research confirmed with Vyacheslav Khayryuzov, Partner at Arno Legal LLC, that a draft law on the processing of personal data and protection of consumer rights, No. 679980-8 was submitted to the State Duma.
Processing of personal data
Vyacheslav outlined that "the draft adds a new sentence to Part 1 of Article 9 of the Federal Law On Personal Data: Consent to the processing of personal data shall be executed separately from other information and (or) documents that the personal data subject confirms and (or) signs. Basically, the idea of deputies is to terminate the practice when personal data consents are hidden inside of bigger terms of service to which users have to abide, which sometimes results in excessive data processing."
Consumer protection
Furthermore, Vyacheslav clarified that "the draft also supplements Article 10 of the Law On Protection of Consumer Rights with a new Clause 4, which reads as follows: The seller (performer, aggregator owner) has no right to restrict the consumer's access to the information provided for in Paragraph 2 of this Article due to the consumer's refusal to provide personal data, except in cases where the obligation to provide such data is stipulated by the legislation of the Russian Federation."
Vyacheslav confirmed that the provisionary entry into force of the law is on March 1, 2025.

Draft law adopted in the first reading
On November 5, 2024, OneTrust DataGuidance Research confirmed with Vyacheslav Khayryuzov, Partner at Arno Legal LLC, that the draft law was adopted in the first reading on October 29, 2024, in the State Duma. Vyacheslav outlined that there have been no amendments so far, and the draft should now pass a 30-day term for the provision of amendments. Two more readings are expected until the draft law is fully adopted by the State Duma.
