Ohio: AG files a lawsuit against several companies for illegal robocalls

The Ohio Attorney General ('AG') announced, on 7 July 2022, that he had filed a lawsuit against several companies for billions of illegal robocalls to US citizens. Moreover, the AG stated that the lawsuit coincides with the Federal Communications Commission ('FCC') issuing cease and desist letters to some of the same targets in the case, as well as the FCC issuing a public notice to all US-based voice service providers, informing them of the letters and authorising them to cut off any traffic from the pertinent targets.

In particular, the AG detailed that the lawsuit accuses the defendants of multiple violations of both the Telephone Consumer Protection Act of 1991 and the Telemarketing Sales Rule of 1995, including:

  • making unlawful robocalls without consent;
  • failing to disclose the callers' identities;
  • placing calls to numbers on the national Do Not Call Registry; and
  • failing to honour Do Not Call requests.
