Prince Edward Island: Health Information Act enters into force
DataGuidance confirmed with the Office of the Information and Privacy Commissioner of Prince Edward Island ('OIPC'), on 4 July 2017, that the Health Information Act 2014 ('the Act') had entered into force on 1 July 2017. The Act gives individuals the right to access their personal health information and to request that a custodian correct any inaccuracies in their personal health information. Section 3 limits the scope of the Act to personal health information that is collected, used, disclosed or in the custody of a health custodian.
In addition, the Act outlines the circumstances in which the consent of an individual will be valid, and, regulates the collection, use and disclosure of personal health information by health custodians. The Act also provides for obligations with respect to data security, the appointment of a data protection officer and the submission of Privacy Impact Assessments to the OIPC.
