Nunavut: OPC and Privacy Commissioner of Nunavut sign MoU to cooperate on privacy issues
The Office of the Privacy Commissioner of Canada ('OPC') announced, on 7 December 2021, that, on 14 October 2021, it had signed a Memorandum of Understanding ('MoU') with the Office of the Information and Privacy Commissioner of Nunavut to facilitate information sharing between the two organisations. Furthermore, the OPC has signed similar MoUs with a number of other provincial data protection authorities. In particular, the MoU's objective is to establish a framework to allow the participants to consult, cooperate, and share relevant information with respect to matters arising under the Personal Information Protection and Electronic Documents Act 2000 ('PIPEDA') and the Access to Information and Protection of Privacy Act, S.N.W.T. of Nunavut of 1994 ('ATIPP').
Specifically, the MoU addresses obligations between the participants, among other things activities such as:
- facilitating cooperation;
- communicating and cooperating with each other about matters arising under PIPEDA and ATIPP;
- using best efforts to notify each other;
- providing notice of possible contraventions;
- providing assistance;
- sharing personal information to the extent that is necessary for fulfilling the purposes of this MoU;
- not using any information obtained pursuant to the MoU for other purposes than those for which the information was originally shared;
- using best efforts to safeguard the security of information;
- respecting the safeguards agreed to by the participants; and
- not retaining personal data for longer than is required to fulfil the purpose for which it was shared or than is required by applicable laws.
The MoU takes effect on the date it was signed.
