Luxembourg: Government approves AI Act bill and appoints CNPD as competent authority
On December 4, 2024, the National Commission for Data Protection (CNPD) announced that on November 29, 2024, the Government in Council approved the bill implementing provisions of the EU Artificial Intelligence Act (the AI Act).
What are the key provisions of the bill?
The bill designates the competent authorities at the national level for the application of the AI Act. The CNPD is one of the competent authorities and will be assigned several roles, including:
- the single point of contact and the national coordination of the competent authorities;
- the market surveillance authority by default (supervision of artificial intelligence (AI) systems in Annex III of the AI Act and AI systems that do not fall under the competence of sectoral authorities);
- the authority in charge of fundamental rights with the Luxembourg Independent Audiovisual Authority (ALIA) and the Inspectorate of Labor and Mines (ITM); and
- the obligation to set up an AI regulatory sandbox.
The bill intends to implement certain provisions of the AI Act and amends:
- the Law on the organization of the CNPD and the general regime on data protection;
- the amended law establishing a financial sector supervisory commission; and
- the amended law on the insurance sector.
