Luxembourg: Chamber of Deputies passes bill implementing Digital Markets Act
The Chamber of Deputies passed, on 23 March 2023, Bill 8164 amending the law of 30 November 2022 on competition with a view to implementing Regulation (EU) 2022/1925 of 14 September 2022 on Contestable and Fair Markets in the Sector and Amending Directives (EU) 2019/1937 and (EU) 2020/1828 ('the Digital Markets Act') and Regulation (EU) 2022/2560 of 14 December 2022 on Foreign Subsidies Distorting the Indoor Market.
Notably, the bill establishes the Luxembourg Competition Authority as the relevant national authority and provides a framework for its cooperation with EU bodies, and, with a view to granting it the powers stemming from the above mentioned EU regulations, amends Articles 8 and 73 of the Competition Law of 30 November 2022. Importantly, under the bill, the Luxembourg Competition Authority will be obliged, among other things, to cooperate with and provide assistance to the European Commission in matters covered under the Digital Markets Act.
