Ireland: DPC welcomes X's suspension of processing for AI training

On August 8, 2024, the Data Protection Commission (DPC) announced that it welcomed the agreement by X (formerly Twitter) to suspend its processing of personal data contained in the public posts of X's EU/EEA users between May 7, 2024, and August 1, 2024.

In particular, the DPC highlighted that personal data was processed by X for the purpose of training its artificial intelligence (AI) system, 'Grok.' The DPC outlined that the agreement was made following a High Court application brought by the DPC under Section 134 of the Data Protection Act, 2018. Specifically, Section 134 of the Act allows the DPC to apply to the High Court for an order requiring the data controller to suspend, restrict, or prohibit the processing of personal data where the DPC considers an urgent need to protect the rights and freedoms of data subjects.

The DPC noted that this is the first time that any lead supervisory authority has taken such action and the first time the DPC has utilized its powers under Section 134 of the Act.
