Ireland: DPC launches inquiry into Google AI model

On September 12, 2024, the Data Protection Commission (DPC) announced that it launched an inquiry into Google Ireland Limited under Section 110 of the Data Protection Act 2018.

The DPC highlighted that the inquiry concerns whether Google complied with obligations to conduct a Data Protection Impact Assessment (DPIA) under Article 35 of the General Data Protection Regulation (GPDR) prior to the processing the personal data of EU/EEA data subjects in developing the artificial intelligence (AI) foundation model, Pathways Language Model 2 (PaLM 2).

The DPC reminded that a DPIA is required to ensure the fundamental rights and freedoms of individuals are adequately considered and protected when the processing is likely to result in a high risk. Article 35 of the GDPR provides that a DPIA is required where a type of processing, taking into account the nature, scope, context, and purposes of processing, is likely to result in a high risk to the rights and freedoms of individuals, in particular when using new technologies.
