Indonesia: Kominfo announces new AI regulations will prioritize innovation

On October 2, 2024, the Ministry of Communication and Information (Kominfo) announced that the Deputy Minister of Kominfo, Nezar Patria, stated that the artificial intelligence (AI) regulations that will be prepared will prioritize the principle of innovation.

In particular, Kominfo outlined that the current use of AI covers cross-sectoral and more complex fields. Therefore, the Government is trying to prepare references or guidelines for users and developers of AI-based applications, including using the level of global developments as a benchmark.

Current situation

Kominfo highlighted that the Circular Letter of Kominfo Number 9 of 2023 concerning the Ethics of Artificial Intelligence emphasizes aspects of inclusivity, humanity, security, accessibility, personal data protection, and sustainable environmental development. The Deputy noted the particular importance of intellectual property rights.

Lastly, Kominfo clarified that Indonesia currently has a set of regulations that can minimize the risk of using AI, such as:

  • Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions;
  • Personal Data Protection Law (PDPL); and
  • Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions and other derivative regulations.
