Grenada: Data protection bill introduced to House of Representatives

The Data Protection Bill, 2023, was introduced, on 8 March 2023, to the Grenada House of Representatives. In particular, the bill aims to establish a comprehensive framework for managing the processing of personal data in Grenada. More specifically, the bill provides for data subject rights such as the right of access to personal data, the right to notice and time when access is requested, the right to denial of access to personal data, and the right to rectification of personal data.

Moreover, the bill would establish seven data protection principles, including data integrity and disclosure. Lastly, the bill provides for the creation of the Information Commission which shall be formed by three members having expertise in data protection and will have the following functions, among others:

  • monitoring compliance by public and private bodies with the provisions of the bill, including issuing notices;
  • advising public and private bodies of their obligations under the bill;
  • receiving and investigating complaints about alleged violations of data subject rights, and in respect thereof make reports to complainants;
  • undertaking educational programmes to promote understanding of the bill; and
  • enforcement functions.
