British Columbia: OIPC issues report on amendments of the FIPPA

The Office of the Information and Privacy Commissioner for British Columbia ('OIPC') published, on 8 June 2022, a report of the Special Committee to Review the Freedom of Information and Protection of Privacy Act ('FIPPA').

In particular, the OIPC detailed that the report consists of recommendations for amendments to FIPPA, organised under the three central purposes of FIPPA: 

  • Access to information. In particular, the report focuses on establishing a culture of transparency and to modernise the freedom of information system by using technological solutions.
  • Protection of privacy. More specifically, among other things the report examines issues associated with new technologies (e.g., de-identification, automated decision-making, biometrics, the right to be forgotten, data linking, and data destruction) and develops regulations that address transparency, privacy protection, and oversight of new technologies.
  • Oversight/enforcement.

Lastly, the report requires consultation with the Privacy Commissioner for new legislation that has implications for access to information or protection of privacy or would override FIPPA.
