Federal US privacy bill on the horizon? Exploring the draft APRA & new state privacy legislation
2024 continues to be dominated by new data privacy legislation across the United States. In April alone Kentucky's Consumer Data Protection Act (KCDPA) became law, Maryland's Act concerning the Maryland Online Data Privacy Act passed the national legislature, Nebraska's Data Privacy Act was approved by the Governor, and the American Privacy Rights Act (APRA) was unveiled. In line with existing US State privacy legislation, the laws in Kentucky and Maryland introduce requirements governing the collection, use, sale, and sharing of consumer data, and establish consumer data rights. At the federal level, the APRA has notable similarities to the American Data Privacy and Protection Act, although the bills also differ in important ways.
