Data Protection Leader Magazine | May 2024
Data Protection Leader is the bi-monthly magazine from OneTrust DataGuidance featuring interviews with some of privacy's top voices as well as expert insight and analysis on trending topics in data protection, cybersecurity, and beyond.
In this edition of Data Protection Leader Magazine also contains articles looking at the EU AI Act, AI Governance structures, US privacy laws, and automated decision making in California as well as interviews and Q&As.
The existential role of global data flows for AI
In his regular editorial, Eduardo Ustaran, Partner at Hogan Lovells, provides us with an article discussing the need to address restrictions of international data transfer in the context of AI development.
“The global network of computers that make up the internet, together with the brains behind them, now provides the ground for AI to exist, but it is the global data used to train, test, and fine-tune AI models that makes the magic happen. Like social media and cloud computing before it, AI development and use is the next technological iteration of a universal need for data to flow around the world. Therefore, it is crucial to address the legal restrictions on international data transfers in a rational, realistic, and responsible way.”
Practical reflections on best practices in building AI governance structures
Monika Tomczak-Gorlikowska and Shravan Subramanyam from Prosus Group take a look at look at the future of AI use and how its evolution links to ethical standards.
“Data and its usage are becoming increasingly critical to economic growth and social development, driving a people-first culture that influences decision-making. The push for equitable technology benefits and the prevention of new or exacerbated forms of discrimination is gaining momentum, as evidenced by initiatives like the 2024 Davos agenda on ethical AI and regulatory actions like the Italian data protection authority's stance on ChatGPT.”
Privacy legislation blooms in busy spring
Bart Huffman, Kevin Angle, and Rachel Marmor, from Holland & Knight LLP, give us an insight into the developments in US state privacy laws from the start of 2024.
“Data law has picked up speed in the hands of state legislatures that are working hard to plug holes and raise guardrails. While the 'laboratories of democracy' framework has worked to push the law forward, it has also resulted in a landscape that is full of stark differences and subtle nuances from state to state”
5 minutes with… Timothy Dickens
OneTrust DataGuidance spent time with Timothy Dickens, Partner at DR & AJU LLC, to talk about his career, advice he would give to those starting in the privacy industry, and who would play him in a movie about his life.
“As far as my data privacy practice is concerned, I never imagined that I would be advising on tech-related type matters, especially considering that I did not have much interest in this field as when I started practicing, we were still using dictation for letters and submissions and emails were still not the preferred choice for sending correspondences. However, due to a large number of our international clients seeking advice on data privacy compliance, the data practice grew organically and I decided to focus and dedicate a niche team within our firm to this practice area.”
