The Directorate for Personal Data Protection ('DZLP') adopted, on 11 May 2020, the rulebook on performing video surveillance ('the Rulebook') and the rulebook on the objectives and evaluation of video surveillance systems ('the Evaluation Rulebook'). In particular, the Rulebook prescribes the manner in which controllers carry out video surveillance and describes the content and form of the application for a video surveillance system, which should include, among other things, the legal basis for processing, a description of the system, the categories of personal data being processed, data retention periods, persons authorised to process the contained personal data, and technical and organisational security measures undertaken. Furthermore, the Evaluation Rulebook outlines that, under Article 1 of the Law on Personal Data Protection 2020, data controllers must analyse, in the form of a report, the objectives for which the video surveillance system is to be implemented before the system can be established. Moreover, the Evaluation Rulebook covers the necessary information to be included in such a report, highlighting the importance of the principles of Privacy by Design and Privacy by Default.
