The Gambia: MOICI announces public consultation on draft cybercrime bill
The Ministry of Information and Communication Infrastructure ('MOICI') announced, on 5 December 2019, that it had launched a public consultation on the draft Cybercrime Bill 2019 ('the Draft Bill'). In particular, the Draft Bill provides for, among other things, the establishment of the cybercrime regulations and a committee. Furthermore, the Draft Bill highlights that a judge may issue a warrant requiring a service provider to collect or record traffic data or intecept content in real time, and provide only the traffic data or the intercepted content to the authorised officer as soon as reasonably practicable. Moreover, the interception of traffic data can take place if, among other things, the privacy of other users, customers, and third parties is ensured, and without the disclosure of information and data of any party not part of the investigation.
Moreover, the Draft Bill stipulates that an act done in relation to a computer system is unauthorised if the person committing the act does not have consent from the person who has the responsibility for the computer system or computer data and is entitled to determine whether the act may be done.
The public consultation period ended on 8 January 2020.
