France: NOYB files complaint against BeReal over alleged dark pattern use

On December 12, 2024, none of your business (NOYB) announced that it filed a complaint against BeReal SAS with the French data protection authority (CNIL) over alleged General Data Protection Regulation (GDPR) violations. 

Background to the complaint

NOYB stated, among other things, that BeReal users in the EU were presented with a consent banner when they opened the BeReal app, and if the users consented to the use of personal data for advertising purposes, the consent banner disappeared. However, if the users refused to provide consent for advertising, the consent banner appeared each time before a user could use the app.

The complaint alleged that BeReal used dark patterns to manipulate users' decisions and that the processing of data on the basis of inadequate consent lacked legal basis and breached the principles of fairness and transparency. The complaint alleged that BeReal violated Articles 4(11), 5(1)(a), 6(1)(a), 7(3), 7(4), and 25 of the GDPR.
