Latvia: DVI publishes guide on lawful data processing and legal bases

On October 10, 2024, the Data State Inspectorate (DVI) published a guide detailing the six legal bases for processing personal data (each of which the DVI has published a guide on):

  • consent (only available in Latvian here);
  • contract performance (only available in Latvian here);
  • legal obligation (only available in Latvian here);
  • public interest or official authority (only available in Latvian here);
  • protection of vital interests (only available in Latvian here); and
  • compliance with legitimate interests (only available in Latvian here).

The DVI emphasized that organizations or managers must evaluate which of these bases is the most appropriate for each personal data processing activity to remain lawful. Furthermore, the DVI highlighted that selecting an appropriate legal basis is critical, as misapplication can lead to unlawful processing and infringe on the rights of data subjects.

Subsequently, using practical examples, the DVI clarified the conditions and limitations of each basis to help organizations select the correct one.
