Israel: PPA publishes opinion on data transfer regulations
On October 13, 2024, the Privacy Protection Authority (PPA) published its opinion on the Interpretation of Regulation 3 of the Privacy Protection Regulations (Transfer of Information to Databases Outside the State's Borders).
Regulation 3 of the Regulations requires the owners of the databases to ensure that the recipient of the information outside of Israel takes adequate measures to ensure the privacy of the information subjects and that the information will not be transferred to a third party.
What are the key provisions of the opinion?
The opinion provides, among other things, that:
- the prohibition on transferring information to a third party outside Israel will not apply when written consent has been given by the party transferring the information from Israel and provided that the information was transferred directly from Israel to the third party; and
- in relation to adequate measures to ensure privacy, controllers may rely on other acceptable guarantees for the protection of the privacy of the data subjects, such as compliance with the EU data protection regulations or the legislation of countries whose laws have been recognized by the EU as compatible with the Regulations.
