Belarus: National Information Centre publishes Law on Amendments to Codes on Criminal Liability
The National Centre of Legal Information of the Republic of Belarus published, on 10 June 2021, the Law on Amendments to Codes on Criminal Liability which introduces penalties for failure to comply with personal data protection requirements. In particular, the Law provides for the following under Article 203:
- the intentional illegal collection or provision of personal data without consent, which results in significant harm to the rights freedoms, and legal interests of the individual may result in a fine, community service, an arrest, restraint of liberty for a term of up to two years, or imprisonment for two years;
- the deliberate illegal dissemination of information about the private life and/or personal data of an individual without their consent, resulting in significant harm to the rights, freedoms, and legal interests of the individual, may result in a restraint of liberty for a term of up to three years, or imprisonment for three years with a fine;
- if the aforementioned actions are committed in relation to an individual or their relatives in connection with the performance of official activities, or the fulfillment of public duty, this may be punished with the restraint of liberty for a term of up to five years, or imprisonment for five years with a fine; and
- failure to comply with measures to ensure the protection of personal data by an individual processing personal data, which, through negligence, resulted in the information being spread which caused significant consequences, may result in a fine, denial of the right to hold certain positions or engage in certain activities, correctional labour for a period of up to one year, arrest, restraint of liberty for up to two years, or imprisonment for up to one year.
