Shenzhen: Shenzhen Special Economic Zone releases draft social credit regulation for public comment

The Government of Shenzhen announced, on 15 April 2021, that it had released the Shenzhen Special Economic Zone Social Credit Regulations and has requested public comments on the same. In particular, the draft regulations outline requirements for the collection and disclosure of public credit information as well as credit subject rights. Specifically, the draft regulation provides that enterprises and public institutions other than credit service agencies must obtain the consent of the credit subject and specify the purpose of collection and use of the credit information to the credit subject. In addition, the draft regulations stipulate that credit subjects have a right to know the source of the information regarding them, inquire about their own credit status, including but not limited to credit information, credit evaluation information, as well as a right to request the deletion, non-disclosure or sharing of their personal information, among other things.
