Vietnam: MPS requests comments on development of Data Law

On February 26, 2024, the Ministry of Public Security (MPS) requested public comments on a report evaluating the impact of the development of a Data Law. In particular, the report highlights its application towards the development of digital government through a National Database, detailing examples of legislation in other jurisdictions that facilitate database access.

Specifically, the report clarifies that although there are multiple regulations applicable to data, such documents do not have a unified approach to the collection, management, operation, and sharing of information in databases. Likewise, the report holds that there are no regulations on data protection when it comes to accessing, retrieving, copying, sharing, transferring, and deleting data. The report also recognizes the importance of a national data strategy owing to the use of data by artificial intelligence (AI) technologies.
