Tanzania: Government publishes EPOCA Online Content Regulations
The Tanzanian Government published, on 17 July 2020, in the Gazette of the United Republic of Tanzania, Government Notice No. 538 regarding the Electronic and Postal Communications (Online Content) Regulations, 2020 ('the EPOCA Online Content Regulations'). In particular, the EPOCA Online Content Regulations apply to online content service providers, internet service providers, application services licensees, online content users, and any other related online content and outlines, among other things, that a person shall not provide online content services without obtaining a licence from the Tanzania Communications Regulatory Authority ('TCRA') and that online content service providers must adhere to certain conditions of the licence. Furthermore, the EPOCA Online Content Regulations detail certain content which is prohibited in the name of personal privacy and respect to human dignity, which includes content that impersonates or claims status of others for fraudulent purposes, content that motivates or promotes data theft, or content that insults, slanders, and defames other persons or exposes news, photos, or comments related to a person's privacy or publication of private information regardless of whether the information is true where publishing the same may harm the person.
