Saskatchewan: OIPC updates rules of procedure
The Office of the Saskatchewan Information and Privacy Commissioner ('OIPC') announced, on 17 August 2022, the entry into force, on 1 September 2022, of the updated Rules of Procedure applicable to reviews and investigations under the Freedom of Information and Protection of Privacy Act, the Local Authority Freedom of Information and Protection of Privacy Act 1990-91, and the Health Information Protection Act. In particular, the OIPC explained that the updated Rules follows from an assessment of the procedures followed by the OIPC to process reviews and investigations related to access to information requests and privacy complaints.
With regards to the updated Rules, the OPIC explained, among other things, that the OIPC will no longer provide draft reports to public bodies/trustees to review, and that, instead, analysts will contact public bodies/trustees before a report is issued if they have any questions or require any clarification regarding the factual circumstances of the review or investigation. Furthermore, the OIPC noted that only in some limited circumstances, the OIPC may exercise discretion to provide excerpts or an entire draft report to public bodies/trustees.
