North Dakota: NDUS announces policy to protect privacy of student data
The North Dakota University System ('NDUS') announced, on 4 June 2020, that the State Board of Higher Education had unanimously voted to implement a new policy ('the Policy') to protect the privacy of student data. In particular, the NDUS outlined that the Policy relates to the collection, use, and access control to students' personally identifiable information ('PII'), and reaffirms various data security components from the Family Educational Right and Privacy Act 1974 ('FERPA') such as students' rights to view their educational records, challenge accuracy and completeness of their educational records, and to restrict access to certain information. In addition, the NDUS noted that the Policy ensures that students' PII is not compromised through licensure agreements with third-party providers of educational services and vendors or the required use of free or open source software applications that captured more than a name or campus issued email address.
