New Jersey: Governor signs bill concerning telemarketers
On May 15, 2023, the Governor of New Jersey signed Senate Bill S921, concerning telemarketers, which was introduced to the Senate on January 31, 2022. The Act amends Section 10 of the Telemarketers Do Not Call Law and provides new requirements for telemarketers making telemarketing calls.
Scope
The Act confirms that the requirements will not apply to any telemarketer who make a residential marketing call in response to a customer's phone call or contact with the telemarketer's website, in which the customer affirmatively requests a follow-up telemarketing sales call or other contact from the telemarketer.
Obligations
The Act establishes that telemarketers must now, during telemarketing calls, provide the name and telephone number of the person on whose behalf the call is being made. In addition, a telemarketer will be required to disclose, on any website owned or operated by the telemarketer and on any subsequent written communication to a customer, the mailing address of the telemarketer, and any company on whose behalf the company is telemarketing.
Importantly, the Act confirms a violation of its provisions constitutes a disorderly person's offense.

The Act will take effect on the first day of the seventh month following enactment i.e., December 2023.
