Myanmar: State Administration Council issues cybersecurity bill
OneTrust DataGuidance confirmed, on 1 February 2022, with Yuwadee Thean-Ngarm and Nwe Oo, Partner and Senior Associate respectively at Tilleke & Gibbins, that the Ministry of Transport and Communication under the State Administration Council had issued a cybersecurity bill, following its introduction in 2021. In particular, Thean-Ngarm and Oo noted that the bill provides definitions for, among other things, information, critical information infrastructure, personal data, and data classification. Furthermore, Thean-Ngarm and Oo highlighted that the bill also establishes restrictions on the use of VPNs, which may result in imprisonment and monetary penalties if a VPN is used without approval for providing online financial services, for trading digital currencies, and for betting and gambling online.
In this regard, Thean-Ngarm and Oo confirmed that the provisions of the bill may be subject to further amendment, and that if enacted, the bill would repeal the Electronic Transactions Law (2004).
The bill was open for stakeholder consultation until 28 January 2022 and has not been made publicly available.
