Myanmar: State Administration Council amends privacy law and electronic transactions law
OneTrust DataGuidance confirmed, on 18 May 2021, with Dr Ross Taylor, Counsel and Head of Financial Services at Tilleke & Gibbins, that the State Administration Council had adopted, in February 2021, amendments to the Law Protecting the Privacy and Security of Citizens (2017) ('the Privacy Law') and the Electronic Transactions Law (2004) ('the Electronic Transactions Law'). In particular, Taylor highlighted that the amendments concern the Government's power to carry out wide-ranging surveillance and investigation activities, while also suspending various sections within the Privacy Law which previously established limits to such activities in view of individual privacy rights. Furthermore, Taylor stated that the amendments also introduce an exception under the Electronic Transactions Law which allows the Government to obtain personal data for purposes related to the stability, tranquillity, and national security of the State.
Separately, Taylor noted that a draft cybersecurity law had been introduced, but such draft has not progressed further.
