Malaysia: Data Sharing Bill passes House of Representatives

On December 12, 2024, Bill D.R. 60/2024, the Data Sharing Bill, passed its second reading in the House of Representatives, following its first reading on December 10, 2024.

What is the purpose of the bill?

The bill aims to provide for the conditions and safeguards for sharing data within the control of a public sector agency with other public sector agencies.

Who does the bill apply to?

The bill binds the Federal Government in Malaysia.

What are the main provisions of the bill?

The bill establishes the National Data Sharing Committee tasked with implementing policies and strategies relating to data sharing.

The bill also provides for requirements for public authorities requesting other public authorities to share data. The bill states that a request for sharing of data may be made and granted for the following purposes:

  • to enhance the efficiency or effectiveness of policies, program management, or service planning and delivery by public sector agencies;
  • to reduce or prevent threats to the life, health, or safety of a person, or threats to public health or safety;
  • to respond to a public emergency;
  • in the public interest; or
  • for other purposes as the Committee may determine.

Additionally, the bill provides possible reasons to deny a data sharing request, as well as measures to ensure the security and privacy of the data.
