Kansas: AG fines Genesis Health Clubs Management $15,000 over violation of the No-Call Act
The Kansas Attorney General ('AG'), Derek Schmidt, announced, on 14 May 2021, that he had fined Genesis Health Clubs Management, Inc. $15,000 for making unsolicited telemarketing calls to consumers registered in the national Do-Not-Call registry, in violation of the Kansas No-Call Act (Kan. Stat. §50-670) ('the No-Call Act'), the Kansas Consumer Protection Act (Kan. Stat. §50-623), as well as the federal Telephone Consumer Protection Act, Telemarketing Consumer Fraud and Abuse Prevention Act, and related federal regulations including the Telemarketing Sales Rule. In particular, the AG outlined that the Consumer Protection Division began investigating Genesis after receiving complaints from Kansas consumers alleging that company employees were making unsolicited telemarketing calls to Kansas consumers on the Do-Not-Call registry.
