Ireland: DPC welcomes outcome of prosecution proceedings against Sempiternal Aesthetics for direct marketing violations

On November 21, 2024, the Data Protection Commission (DPC) announced the outcome of the prosecution proceedings against Sempiternal Aesthetics Limited t/a SISU Clinic that was taken in at Cork District Court.

The DPC noted that on November 20, 2024, Sempiternal Aesthetics pleaded guilty to six charges of sending unsolicited marketing emails to a customer without consent and six charges relating to the failure to provide the customer with a valid address to opt out of receiving such communications.

The DPC issued a warning previously to Sempiternal Aesthetics in June 2023, which followed the investigation of a complaint from a member of the public in relation to marketing emails and requests for opt-outs not being respected.

The Court applied the Probation Act to all 12 counts based on the fact that Sempiternal Aesthetics had engaged with the DPC and rectified its systems to ensure that this issue would not happen in the future. Sempiternal Aesthetics was subsequently ordered to pay €500 towards the legal fees of the DPC.
