International: EU and ASEAN launch guide on model clauses for data transfers
On May 24, 2023, the European Commission announced that the EU and the Association of Southeast Asian Nations (ASEAN) issued a joint guide that identifies commonalities between the EU Standard Contractual Clauses (SCCs) and the ASEAN Model Contractual Clauses for Cross-Border Data Flows (MCCs). The guide aims to help businesses that operate in the two regions, either as data exporters or importers, to understand the similarities and differences between the SCCs and the MCCs in order to facilitate their compliance with the relevant data protection requirements. More specifically, the guide covers both obligations for controller-to-controller transfers and obligations for controller-to-processor transfers.
Separately, the guide specifies that it represents part one of a two-part series, indicating that the second part will provide best practices from companies that use both the SCCs and the MCCs for transferring data.
