Greece: HDPA amends its Regulation of Operation
On October 7, 2024, the Hellenic Data Protection Authority (HDPA), in Decision No. 35/2024, published the amendments to the Regulation of Operation of the HDPA (Decision No. 9/10.2.2022).
The HDPA decided to amend Article 3(c) of the Regulation by allowing the President of the HDPA to delegate his powers to not just the Deputy president or one or more regular members but also to a substitute member. The HDPA noted that considering that substitute members participate to a significant extent and practically on an equal footing with regular members, the amendment is appropriate in order to fully utilize all the members of the Authority and for faster processing of cases.
Furthermore, the HDPA amended Article 4 of the Regulation, which defines the responsibilities of bodies of the Authority. The amendment seeks to extend the powers of providing opinions beyond the President to a department or individual, especially in cases where the considered request does not concern novel processing of personal data and there is established jurisprudence of the Authority or the European Convention on Human Rights (ECHR) or the supreme courts.
The decision will take effect after the amendments are published in the official government gazette.
