Germany: Bundesnetzagentur issues statement on smart devices

On November 29, 2024, the Federal Network Agency (Bundesnetzagentur) issued a statement urging people to be cautious with smart devices that can violate privacy. 

The Bundesnetzagentur stated, among other things, that smart devices with built-in cameras and microphones pose risks to privacy if they can make audio or video recordings unnoticed and transmit them to other devices, and such products are not permitted in Germany. Smart devices are banned in Germany if:

  • they record audio and/or video unnoticed; and
  • they can transfer the audio/video wirelessly to other devices, for example via Wireless Local Area Network (WLAN) or Bluetooth.
