EU: EDPB publishes reply to AI Office regarding DPA role under AI Act

On November 28, 2024, the European Data Protection Board (EDPB) published a response to a letter from the Artificial Intelligence Office (the AI Office) regarding the EDPB statement on the role of data protection authorities (DPAs) in the EU Artificial Intelligence Act (the AI Act) Framework.

In the letter, the EDPB outlined, among other things:

  • the importance of consistency and cooperation with other regulatory authorities to promote the right to data protection in different regulatory frameworks and the EDPB's support for the establishment of appropriate cooperation mechanisms;
  • the current work on guidelines on the interplay between the General Data Protection Regulation (GDPR) and the AI Act;
  • invitation to attend the EDPB plenary meeting of December 2-3, 2024;
  • the need for taking due account of the requirements under Article 74(8) of the AI Act regarding high-risk AI systems; and
  • the current work on Article 64(2) of the GDPR Opinion on artificial intelligence (AI) models, with the adoption deadline of December 23, 2024, as well as the EDPB's readiness to present the opinion during a future meeting of the AI Board, in the first semester of 2025.
